An $85,000 RECOVERY

An $85,000 recovery for our male client in a legal malpractice case in 2001 against a lawyer who failed to file a lawsuit against the responsible parties within the two-year statute of limitations stemming from a motor vehicle accident causing neck and back injuries.  We obtained a settlement of $70,000 on behalf of our client against the lawyer's insurance company.  After the settlement, my office filed a motion with the Superior Court for an additional legal fee of one-third of the $70,000 based upon prior case law that held that a negligent attorney was responsible for reasonable legal fees incurred by former clients in pursuing a legal malpractice claim. The court denied the motion and held that there were no additional fees caused by the malpractice and additional fees would be a windfall above the settlement amount of $70,000 that made the client whole. This office filed an appeal with the Appellate Division. It was a case of first impression in the state and the New Jersey Law Journal wrote a front-page article on the case. Another law firm filed an amicus brief to represent several malpractice insurance companies as this was a very important legal issue moving forward. However, the case settled, before the Appellate Division made a decision, for an additional $15,000 for a total settlement of $85,000.
