The statute NJSA 39:6B-2 for operating a vehicle without liability insurance is a very serious offense and a conviction for a first offense will result in an automatic one year loss of driver's license and community service. A second offense also carries a mandatory 14 days in jail. This can be a severe result especially if it was simply an error in paperwork that resulted in the nonpayment of the insurance premium resulting in cancellation of the policy. If the operator does not own the uninsured vehicle then the burden is on the prosecutor to prove that the driver knew or should have known that the vehicle was not insured.
