The police may obtain a search warrant from the court for extraction of blood from a person accused of DWI. The blood sample must be taken in a medically acceptable manner usually in a hospital. Extraction most often occurs when an Alcotest cannot be done after a motor vehicle accident if the driver is injured and taken by ambulance to the hospital or when the Alcotest device for that police department is in disrepair and there are no available Alcotest devices in neighboring police departments. The state police blood alcohol laboratory reports showing the BAC readings often are allowed to be admitted into evidence at trial without the necessity of testimony from the forensic chemist who performed the tests.   A good defense lawyer will request from the state the gas chromatographs and have them reviewed by an expert to ensure that the state police lab was correct in their analysis of the blood evidence.
