If a person sustains injuries due to the fault of a public entity such as a Municipality, County or State of New Jersey then a Notice of Tort Claims form must be completed and sent to the public entity within 90 days of the event or accident or withing one year of the event or accident with court approval. These cases usually require a showing of more than ordinary negligence before recovery would be allowed. For example in order to recover for injuries you must prove that a dangerous condition existed and the municipality knew or should have known about it and the failure to not remedy the dangerous condition was palpably unreasonable.
