WORKMANS COMPENSATION ACCIDENTS

There is no requirement for an injured party to prove negligence to recover in a workman's compensation case for injuries sustained at work. The law allows recovery including payment of medical expense, lost income and the value of permanent injuries. If a person is injured in an accident while working for a company then in addition to the workman's compensation claim against the employer there would be a potential third party lawsuit for negligence against the negligent party  causing the accident. Monies paid by the insurer in the workers compensation case for medical bills, lost income, and permanent injuries becomes a lien on the third party claim meaning that the injured party must repay two-thirds of the worker's compensation lien from the proceeds of any recovery or settlement in the third party case.
