The statute NJSA 39:3-40 for operating a vehicle while suspended is a very serious offense which could result in high fines, further suspension of driver's license and jail time. Jail of 10 days or more is mandatory if it is a third or subsequent conviction. There are enhanced additional penalties including greater periods of jail and license suspension if the license was suspended due to a prior conviction for DWI or refusal to submit breath samples or operating a motor vehicle without insurance or if the operator was involved in an accident with injuries while suspended.
