FIELD SOBRIETY TESTS
The police usually request persons suspected of DWI to perform field sobriety tests to determine if they were operating a motor vehicle while intoxicated and whether they should be arrested and taken to the police station to perform breath tests. The standard field sobriety tests include the Walk and Turn test, the One Legged Stand test, the Heel to Toe Test and the Horizontal Gaze Nystagmus test. Poor performance on these tests are used by the prosecution to prove that a person was intoxicated while operating the motor vehicle. Sometimes poor performance on the tests may be the result of other factors such as physical injuries, improper demonstration or instructions by the police, and poor lighting or roadside conditions, and these defenses should be raised by the defense attorney.
