PASSING A STOPPED SCHOOL BUS

The statute 39:4-128.1 is violated when a motorist passes a stopped school bus with its red lights on and its stop sign extended and results in five motor vehicle points as well as substantial fines. Most of the time the summonses are issued by school bus drivers to the owner of the motor vehicle. There is a rebuttable presumption that the owner of the vehicle was the operator which may be challenged at trial.
