The statute NJSA 39:4-49.1 for possession of drugs while operating a motor vehicle is a serious motor vehicle offense which is separate and apart from the disorderly persons offense of possession of marijuana or other controlled dangerous substances. Often persons are charged with both the criminal offense and the motor vehicle offense. A conviction would result in a two years loss of license plus fines and costs.
