Consumer fraud occurs if the defendants have engaged in the use of unconscionable commercial practices, false promises, misrepresentations, or the knowing concealment, suppression, or omission of material facts in violation of the Consumer Fraud Act N.J.S.A. 56:8-2. The plaintiffs must rely upon the false promises and/or misrepresentations and sustain damages to have a valid case under the consumer fraud statute. Some examples are cases brought against contractors for performing shoddy or poor work on a home or against motor vehicle repair shops for making false claims about items in need of repair or performing faulty repairs on an automobile.
