OPERATING A VEHICLE UNDER THE INFLUENCE OF ALCOHOL PORTION OF THE DWI STATUTE
The second portion of the DWI statute is that a person is operating a motor vehicle while under the influence of alcohol. Generally that means a substantial deterioration or diminution of mental faculties or physical capabilities of a person due to intoxicating liquor. In other words was the driver's physical coordination or mental faculties impaired? Evidence of intoxication usually is analyzed by a totality of circumstances including poor driving, slurred speech, bloodshot eyes, slow hand movement, demeanor, messed clothing, odor of alcohol from the person, slow movements, difficulty with balance, standing, and walking and poor performance on field sobriety tests.
