PER SE VIOLATIONS
The state has to prove only one of the two prongs of the DWI statute for a conviction. A per se violation under the first prong of the statute is established if the Alcotest or blood test results show that the driver's blood alcohol concentration is at least .08% blood alcohol concentration (BAC).
